Email Marketing Guide for India: List Building, Consent and the DPDP Act, Segmentation, Deliverability and Tools

Email is the one marketing channel you fully own. This guide covers how to build a list the right way under India's data protection law, send email that reaches the inbox, and measure what matters.

Email marketing guide cover for Marketing and Growth
Quick answer: Email marketing is sending planned, permission-based emails to people who asked to hear from you, such as welcome series, newsletters, offers and cart reminders. In India, collect consent that is clear and specific: the DPDP Act, 2023 requires consent to be free, specific, informed, unconditional and unambiguous with a clear affirmative action, and withdrawing it must be as easy as giving it. To reach the inbox, authenticate your domain (SPF, DKIM and DMARC), offer one-click unsubscribe, and keep spam complaints below 0.3% as Gmail requires for bulk senders.

Why does email marketing still matter?

Social reach depends on algorithms and ad reach depends on budget. An email list is an audience you can reach whenever you choose, at low cost per message. That makes email the channel most businesses use for onboarding new customers, bringing back past buyers and nurturing leads that are not ready to buy yet.

For Indian businesses, email sits alongside WhatsApp and SMS rather than replacing them. A common pattern is WhatsApp for time-sensitive updates (order shipped, appointment reminder) and email for longer content, receipts and nurture sequences.

How do you build an email list?

Offer something specific in exchange for an email address, and ask at the moment it is relevant. Examples that work in Indian markets:

  • D2C brand: a first-order discount or a skin-type quiz with personalised results by email.
  • B2B SaaS: a template, a benchmark report or a webinar recording.
  • Coaching or edtech: a free class, a study plan or a sample chapter.
  • Local business: a booking confirmation with an opt-in box for occasional offers.

Never buy or scrape lists. Beyond the legal risk, bought lists contain old and trap addresses that damage your sender reputation, so even your genuine subscribers stop receiving your mail.

Use a double opt-in (a confirmation email with a link) for newsletters and lead magnets. It lowers list growth slightly but keeps typos and fake addresses out.

What does India's DPDP Act mean for email marketing?

The Digital Personal Data Protection Act, 2023 governs how organisations handle digital personal data, and an email address linked to a person is personal data. This section is a plain-English summary for marketers, not legal advice. Check the official text and take legal advice for your business.

RequirementWhat the law says (summary)What it means for your email programme
Notice (Section 5)When asking for consent, tell people what personal data you collect, the purpose, and how to exercise their rights and complainA short, clear notice next to the sign-up form, linked to your privacy policy
Valid consent (Section 6(1))Consent must be free, specific, informed, unconditional and unambiguous with a clear affirmative action, limited to the data needed for the stated purposeUnticked checkbox for marketing emails; no pre-ticked boxes; do not bundle marketing consent with accepting terms of sale
Language (Section 6(3))Consent requests must be in clear and plain language, with the option to read them in English or any Eighth Schedule languageOffer the notice in the languages your customers use
Withdrawal (Section 6(4))The right to withdraw at any time, with the ease of doing so comparable to the ease of giving consentVisible one-click unsubscribe in every marketing email; stop sending promptly
Penalties (Schedule)The Data Protection Board can impose penalties; the highest cap is up to ₹250 crore for failing to take reasonable security safeguards, and up to ₹50 crore for other breaches not listed separatelyProtect your list: limit access, use reputable tools, remove data you no longer need

When do the rules apply?

The government notified the DPDP Rules, 2025 in November 2025 with an 18-month phased timeline. The Press Information Bureau release says the Rules require standalone, clear and simple consent notices that explain the specific purpose of data collection. Most operational obligations, including the notice and consent rules, apply at the end of the 18-month period, which falls in May 2027. Businesses setting up email programmes now should build to the standard from the start rather than retrofit later.

A compliant sign-up form, in practice: an email field, an unticked box saying "Send me weekly tips and offers from [Brand] by email. I can unsubscribe any time", a one-line notice with a link to the privacy policy, and a record of when and where each person consented.

How should you segment an email list?

Segmentation means sending different emails to different groups so each email is relevant. Start with three or four segments, not thirty.

Segment byExample segmentsExample email
Lifecycle stageNew subscriber, first-time buyer, repeat buyer, lapsedWelcome series; "how to use your purchase"; win-back offer after 90 days
InterestSkincare vs haircare; SEO vs paid adsContent only about the category they clicked
BehaviourViewed product, abandoned cart, attended webinarCart reminder; webinar recording and next step
EngagementClicked in last 90 days vs notSend more to engaged readers; re-permission or remove inactive ones
Location or languageMetro vs non-metro; Hindi vs EnglishRegional festival offers; delivery-time messaging

Which automated emails should you set up first?

  1. Welcome series (2–4 emails): deliver what you promised, set expectations, introduce your best content or products.
  2. Abandoned cart or abandoned form: for e-commerce and lead-gen sites with enough traffic.
  3. Post-purchase: usage tips, review request, cross-sell.
  4. Win-back: for customers who have not bought or opened in a set period.

How do you make sure emails land in the inbox?

Deliverability is whether mailbox providers accept your mail and put it in the inbox. Gmail's sender guidelines, in force since February 2024, set clear rules. Gmail defines a bulk sender as one sending close to 5,000 or more messages to personal Gmail accounts in 24 hours.

  • Authenticate your domain. All senders need SPF or DKIM; bulk senders need SPF, DKIM and DMARC, with the From domain aligned.
  • One-click unsubscribe for marketing messages from bulk senders, plus a visible unsubscribe link. Gmail recommends processing unsubscribes within 48 hours.
  • Keep spam complaints low. Gmail recommends staying below 0.1% and never reaching 0.3%. Track this in Google Postmaster Tools.
  • Send from your own domain, not a free Gmail or Yahoo address.
  • Warm up new domains by starting with your most engaged subscribers and increasing volume gradually.
  • Clean your list of hard bounces immediately and of long-inactive subscribers regularly.

Which email marketing metrics matter?

MetricWhat it tells youCaution
Delivery rate and bounce rateList quality and technical setupRising hard bounces signal a list problem
Open rateSubject line and sender recognition, roughlyUnreliable: Apple Mail Privacy Protection prevents senders seeing whether a message was opened
Click rateWhether content and offer interest readersThe most reliable engagement metric for most teams
Conversion rate and revenue per emailBusiness impactNeeds UTM tags and analytics set up
Unsubscribe and spam complaint rateRelevance and frequencySpikes after a send mean the wrong people or wrong message
List growth rateHealth of your acquisitionGrowth from bought or low-quality sources hurts later

Tag links with UTM parameters so GA4 attributes sessions and conversions to email. Our GA4 tutorial explains the setup. We have not quoted "average open rates" here, because published benchmarks vary widely by source and industry.

How does email marketing fit into a marketing career?

Email and CRM roles exist in D2C brands, fintech, edtech and SaaS companies, often called CRM executive, lifecycle marketer or marketing automation specialist. Interviewers usually ask you to design a welcome series or explain a drop in click rate. A portfolio piece that shows a segmented welcome flow, subject line tests and a measurement plan answers both; see digital marketing interview questions for how such questions come up.

Frequently Asked Questions

Is email marketing legal in India?

Yes, when you collect and use email addresses lawfully. Under the DPDP Act, 2023, consent must be free, specific, informed, unconditional and unambiguous with a clear affirmative action, and people must be able to withdraw it as easily as they gave it. This is a summary, not legal advice.

When do the DPDP Rules apply to email marketers?

The DPDP Rules, 2025 were notified in November 2025 with an 18-month phased timeline. Most operational obligations, including consent notices, apply at the end of that period in May 2027. It is sensible to build compliant sign-up forms now.

What is a good email open rate?

Open rates are no longer reliable because Apple Mail Privacy Protection stops senders seeing whether emails were opened. Track click rate, conversions and spam complaints instead, and compare against your own past sends rather than generic benchmarks.

Why are my emails going to spam?

Common causes are missing SPF, DKIM or DMARC records, sending from a free email address, a high spam complaint rate, bought or old lists, and sudden jumps in volume. Gmail asks bulk senders to keep spam rates below 0.3 percent and recommends staying under 0.1 percent.

Which is the best free email marketing tool in India?

It depends on your needs. Checked September 2026, Zoho Campaigns offers a free plan with up to 2,000 contacts and 6,000 emails a month, Brevo offers 300 emails a day free, and Mailchimp's free plan covers up to 250 contacts.
